Assume you are a nurse manager on a unit where a new nursing documentation system is to be implemented. You want to ensure that the system will be usable and acceptable for the nurses impacted. You realize a nurse leader must be on the implementation team.

Week 2: Common Screenings for Women

Many screening procedures are often recommended and routinely used with women to detect diseases in the earliest stages possible. Consider Cindy, who was 28 years old when she received the results of her annual pap smear. The results of the test were abnormal, leading to a diagnosis of human papillomavirus (HPV). While Cindy’s type of HPV did not require treatment, subsequent annual pap smears were highly recommended due to risks associated with the disease. Five years later, after another round of abnormal screening results, Cindy was diagnosed with aggressive cervical cancer, which was then successfully treated (Tamika & Friends, Inc., 2011). For diseases like cervical cancer, screenings and early detection can save patients’ lives, as it did in Cindy’s case. As an advanced practice nurse caring for women, you must be able to provide recommendations for screening tests, interpret test results, and develop care plans that meet the unique needs of patients.

Discussion: Guidelines on Screening Procedures

“THYROID DISEASE”

The goal of health promotion and education is to help prevent disease in patients. However, this is not always successful, and disease it not always preventable. With disease, early detection is ideal, often making screening procedures a routine part of clinical care. Unfortunately, many patients do not utilize these health services. This can be attributed to lack of awareness or access to care, financial concerns, or even levels of comfort with health care providers. In your role as the advanced practice nurse, you must be aware of potential obstacles for patients and implement strategies to ensure patients receive necessary screenings. Although a variety of screening procedures are recommended for women at various stages of life, not all screenings are appropriate for all patients. Understanding the strengths and limitations of each screening, as well as current guidelines for use is essential to effectively facilitate patient care. For this Discussion, the course Instructor will assign a specific topic for you to research.

To prepare:

  • Review this week’s media presentation, as well as Chapters 6 and 8 of the Tharpe et al. text and the U.S. Department of Health and Human Services article in the Learning Resources.
  • Research guidelines on screening procedures for the topic assigned to you by the course Instructor (e.g., guidelines on screening for domestic violence, safety, nutrition, osteoporosis, heart disease, mental health, eating disorders, thyroid disease, pap smear, mammogram, cancer, and sexually transmitted infections). Note: The course Instructor will assign a topic to you by Day 1 of this week.
  • Reflect on strengths and limitations of the screening guidelines.
  • Consider how the guidelines might support your clinical decision making.
By Day 3

Post an explanation of the guidelines on screening procedures for the topic assigned to you “THYROID DISEASE”. Include an explanation of strengths and limitations of the guidelines. Then, explain how the guidelines might support your clinical decision making.

By Day 6

Respond to at least two of your colleagues on two different days who were assigned different topics than you. Explain a patient scenario in which your colleague’s guidelines might not be appropriate. Then, explain how you would provide care for the patient in the scenario. Finally, explain how you, as an advanced practice nurse, might be able to impact issues related to these screening guidelines.

·         In the first assignment, you reflected on whether the policy you would like to promote could best be achieved through the development of new legislation, or a change in an existing law or regulation. Refine as necessary using any feedback from your first paper.

·         Contemplate how existing laws or regulations may affect how you proceed in advocating for your proposed policy.

·         Consider how you could influence legislators or other policymakers to enact the policy you propose.

·         Think about the obstacles of the legislative process that may prevent your proposed policy from being implemented as intended.

Fourth Amendment Right to Privacy

Your assignment is to:

  1. methodically review the Court Case (Fourth Amendment Right to Privacy) case in chapter 8 of your text book; 2. state, compare, and contrast the simple rules of law found in each case; and 3. comment on the jurisdictions or courts the cases come from and the impact they will have on healthcare where you are going to be employed. 

You may adjust the margins and the fonts when necessary.  However, I would prefer that your answers be in 12 point font or greater “if possible”.  Do not let your work exceed one page.

Exercise your ability to concisely summarize without leaving out important facts.  Be realistic yet creative in your answers.  Assume that your boss, who only has a limited amount of time to deal with any issue, will be making business decisions upon the information that you provide and the authority to grant you the promotion that you strongly desire.

When writing your responses use as many applicable “key words” from the chapter as possible.  Make sure that you are using them correctly.  Never take credit for work that is not yours.  When in doubt, use quotation marks and tell where the information came from.   Remember, be concise, one page is the limit.  Make only one submission to Assignments for this assignment.  Use your best writing skills, spell check at least three times, and save that hard work that you have done.

Fourth Amendment Right to Privacy

Every state in the nation, except Missouri, has a prescription monitoring database. The original purpose of these prescription drug monitoring program (PDMP) databases was an attempt to address the overdose deaths attributed to prescription medication, prescription drug diversion, and doctor shopping. PDMPs were intended to help law enforcement find the physicians who were overprescribing pain medications in a pattern that indicated possible fraud. Each state’s laws and databases were different.

However, access to PDMPs for purposes other than limiting illicit use of opioid narcotics has created questions about Fourth Amendment rights. State laws vary in terms of what drugs are tracked and who in the law enforcement community, as well as the health care community, has access to these databases. Only 19 states require a warrant for law enforcement to access their PDMP.

Oregon created its PDMP in 2009, prioritizing patient privacy and requiring a court order for law enforcement to search the PDMP. The federal Drug Enforcement Agency (DEA) ignored that law and filed administrative subpoenas in pursuit of investigations into drug diversion. The DEA argued that it has a compelling interest that supplants privacy under the Fourth Amendment and that requiring a warrant affects its ability to conduct a timely and effective investigation.

The state of Oregon filed a lawsuit against the DEA, and the American Civil Liberties Union (ACLU) joined the case. In early 2014, a U.S. District Court granted the plaintiffs motion for summary judgment and denied the federal government’s motion, with the result that the DEA must get a warrant to access the prescription records in Oregon. The DEA has appealed that decision, but as of July 2016, no decision has been reached at the federal appellate level.

In another case in July 2015, a U.S. District Court judge in Texas ruled for the DEA that an administrative subpoena may be used to search medical records. That case is also under appeal.

In July 2016, the ACLU filed a similar case in Utah.
