LEGAL MEMORANDUM: OSHA, Administrative Law help

Legal Memorandum: OSHA

The Occupational Safety & Health Administration (OSHA) conducted a study involving accidents and injuries involving printing presses at printing companies.

The study found that 88% of the accidents involved employees that were under the influence of drugs. As a result, OSHA promulgated a regulation pursuant to a delegation of rulemaking authority, which read:

  • Applicability of Law
  • § This law applies to any business that operates any type of printing press machinery
  • Mandatory Drug and Alcohol Testing—Printing Press Operators
  • § All printing company employers shall require all printing press operators to submit to a blood or urine test designed to detect the presence of controlled substances if the employer has a reasonable suspicion, based on particularized facts, that an employee is impaired while at work. Such test is to be conducted in a safe and medical environment. Urine testing shall be conducted privately without the presence of witnesses. If a test reveals that the employee is impaired, the employer may either suspend the employee or require the employee to enroll in a certified treatment program. Employees that choose to undergo treatment will be tested again within 30 days and must successfully pass. Any employee who tests positively and refuses to undergo treatment will be terminated at the employer’s discretion. Employees may contest the results of the test at a hearing that is to be conducted within 48 hours of the suspension or referral for treatment.
  • Mandatory Pat Down/Strip Search – Printing Press Operators
  • All employers shall require their printing press machine operators to submit to a full body pat down and/or strip search if the employer has a reasonable suspicion, based on particularized facts, that an employee is impaired while at work. Such pat down and/or strip search is to be conducted in a private setting away from other employees. If illegal drugs or non-prescribed drugs are found in the possession of the printing press machine operator, the employer is to immediately suspend the employee and conduct a hearing on the fitness of the employee to continue work within 48 hours of the suspension. The employee may contest the results of the personal body search at that hearing.

Just answer some simple question you wrote for me before

Hi, i have some problems about the question i asked you last time

First, make brief answer for this which the teacher asked me

Estonia is a developing country in that it is relatively new to handling international business issues. Using Hofstede’s criteria (p. 120 in your text) describe the culture for business people new to Estonia.

And i have to response two other students in class, below are their airticle, just brief response, whatever from which aspect

First one

Anholt describes a “Good Country” as being one that makes decisions based on the greater good of not only humanity, but the environment as a whole. (Anholt, 2016) The actions of individuals, cities, and entire nations can either make great contributions to the world or cause serious damage. Typically the goal of each nation is to advance by doing whatever it takes to create a more profitable, stable, and globally influential nation for its people.Anholt is not only bringing awareness to the global issues, but also suggests that the “culture of governance worldwide” must change to yield the best results. (Anholt, 2016)

The South American nation of Chile is ranked 24th on the Good Company Index. Though Chile is “gooder” than 80% of the other nations on The Good Company Index, there is significant room for improvement. (Anholt, 2016).  Chile can use moderate improvement in the categories of Science and Technology- 52nd; Culture- 47th; and International Peace and Security-42nd. The area of Science and Technology can improve by adding more international students. In order to become more attractive to foreign students, Chile will first need to improve their Health & Wellbeing category which currently has a ranking of 114. The Culture category can easily be improved by exporting more creative exports to inform other areas of the globe about Chile’s cultural background.

The safety within the nation and their contribution internationally as a result of Chile’s citizens is detrimental to the ranking of how good Chile is. Chile makes a substantial negative contribution to humanitarian aid. This may be a result of Chile requiring large amounts of humanitarian aid while not contributing much to other areas of the world.  International Peace and Security can be improved by reducing the “number of casualties of international organized violence.” (Anholt, 2016) The reduction of crime in Chile will result in children maturing into law abiding citizens. Such citizens will also consider doing things such as contributing to humanitarian aid and subsequently improving Chile’s Health and Wellbeing ranking.

Chile’s unemployment rate is at an impressive 5.8% as of January 2016. (Economy, 2016) While the great majority of Chile citizens are employed, they may not occupy the jobs that are needed to make Chile into a globally aware nation. Managers should focus on shaping their employees into the pillars of community that are willing to donate their time to educate the younger generations or volunteer for various humanitarian aid programs. The Chilean government has limited time to devise a plan as in recent years Chile has undergone “traumatic ups and down and is now challenged to grow.” (Forbes, 2015)The Chilean government should create government funded programs or incentives to encourage citizens to give their time to improve the nation that they call home.

Second one

Managers in Mongolia should focus on rebuilding the interest that once existed in foreign direct investment, or FDI (Forbes 2015). To do this, they need to leverage the strengths of the country, such as the growing interest in Mongolia’s nature resources (Murphy, 2003), while doing their part to reduce the unattractive aspects of Mongolia within their control, for example reducing their carbon footprint by investing in cleaner manufacturing practices. The face that Mongolia according to the God Country Index, is 101st in global contribution to planet and climate shows that there is a lack of corporate social responsibility (Luthans, 2015), and likely even less government regulations holding managers to environmental standards.

Geographical challenges are something managers in Mongolia are somewhat handcuffed by. The majority of the trade in Mongolia is with China, and they receive the most of their energy resources, such as gasoline and diesel, from Russia (Forbes, 2015). This leaves the country vulnerable to price hikes on both fronts. To counteract this, mangers could look to other prospective countries for trade sources, however the landlocked country only borders the two aforementioned countries, making FDI even more important (Narangoa, 2012).

To increase FDI, managers could look into partnerships with major producers of their needed materials. Beyond that, managers could lobby political figures for tax breaks and leverage the commitment the new government made to restoring investor trust and jumpstarting the current economy (Forbes, 2015).

By making their voices heard in a political sense, and doing their part to become better stewards of the global environment, I would expect that economic growth would be a slow process, but a sustainable (Luthans, 2015) one. A country like Mongolia, with its geographical and weather challenges (Murphy, 2003), is not going to change overnight. A good relationship with the government and a notable effort toward a cleaner environment should be the first step for managers in Mongolia.

Diagnostic results:

Ankle x-ray- If the Ottawa ankle rule is positive (bone tenderness at posterior malleolus, bone tenderness at posterior medial malleolus, or inability to bear weigh > 4 steps) ankle radiographs are indicated (Polzer, Kanz,  Prall, Haasters, Ockert, Mutschler, & Grote, 2012).

If ankle radiographs negative- assess ligament in affected extremity as compared to un-injured extremity by doing the crossed leg test, squeeze test, external rotation test, anterior drawer test, and talar tilt test. These tests will assist in determining the need for an MRI and also grading the sprain  (Polzer, Kanz,  Prall, Haasters, Ockert, Mutschler, & Grote, 2012).

Labs may include a uric acid level which is elevated with gout and a WBC which would be elevated with  osteomyelitis. MRI imaging may also be indicted.

A.

Sprain- because the patient heard the “pop” sound, her injury is likely related to an ankle sprain in which the ligaments and tissue that surround the bones of the ankle are injured causing swelling, pain, and limited ROM  (PubMed Health, 2018).

Fracture- a fracture would be unlikely if the patient was able to bear weight after the injury. The area would also become ecchymotic with limited to no ROM (PubMed Health, 2018).

Osteomyelitis- the extremity would be warm, erythematous, not usually associated with an acute injury, potential fever present, usually associated with a systemic infection or a wound (Ball, Dains, Flynn, Solomon, & Stewart, 2015)

Gout- associated with hot, swollen joints, pain and limited ROM (Ball, Dains, Flynn, Solomon, & Stewart, 2015)

Bursitis- limited ROM, swelling, pain, warmth, and point tenderness (Ball, Dains, Flynn, Solomon, & Stewart, 2015)

fin 400 disc statement of cash flow, business and finance homework help

This week we are studying the statement of cash flows. Operating cash flow represents the cash that flows in and out of the company on a day-to-day basis. For example, cash inflows come from collected revenues and cash outflows occur when the firm pays its normal day-to-day expenses.  We, of course, would prefer to see a positive total on the net cash provided by operating activities, because it implies that cash inflows are greater than cash outflows. In your textbook, the author discusses 4 financial ratios associated with operating cash flows; please study these ratios. Remember that the denominator on the ratio operating cash flow/current maturities of long-term debt is being revised to current liabilities; therefore, we will report the ratio as operating cash flow/current liabilities (see discussion on Page 3 of the Module 5 lesson).

This week, find the statement of cash flow for a firm of your choosing and report the cash flow ratios.  Please report and discuss 3 years of ratios for the three ratios related to debt and dividends but only the current year’s cash flows per share.  Show numerators and denominators for all ratios and then discuss their economic meaning. It is possible that your firm does not pay dividends (you will see dividends in the financing section of the cash flow statement).

The cash flow per share ratio is particularly challenging since most of the numbers in the statements are in thousands or millions (look at the top of the statement for a note) while the number of shares outstanding only for the current year (in yahoofinance, under your firm’s page, look in “Key Statistics” and you will find the number of shares in the right-hand column about halfway down the page).  You only have to report ONE YEAR on the cash flow per share.  Please do not report on Nike, as that will be the firm posted as an example.  Again, please do not duplicate firms by including the name of your chosen firm in the title to your post.  Also, please respond to questions/comments from your instructor regarding your post.

Discussion

Andrea Tabares was just hired as the assistant treasurer of Northshore Stores, a specialty chain store company that has nine retail stores concentrated in one metropolitan area. Among other things, the payment of all invoices is centralized in one of the departments Andrea will manage. Her primary responsibility is to maintain the company’s high credit rating by paying all bills when due and to take advantage of all cash discounts.

William Parks, the former assistant treasurer, who has been promoted to treasurer, is training Andrea in her new duties. He instructs Andrea that she is to continue the practice of preparing all checks “net of discount” and dating the checks the last day of the discount period.

“But,” William continues, “we always hold the checks at least four days beyond the discount period before mailing them. That way we get another four days of interest on our money. Most of our creditors need our business and don’t complain. And, if they scream about our missing the discount period, we blame it on the mail room or the post office. We’ve only lost one discount out of every hundred we take that way. I think everybody does it. By the way, welcome to our team!”

  • What are the ethical considerations in this case?
  • What stakeholders are harmed or benefited?
  • Should Andrea continue the practice started by William? Does she have any choice?
Please give enough supporting details to your discussion. Also, any citations used should conform to APA format.

Public Health, PowerPoint presentation help

PowerPoint Presentation with a title slide and reference slide that has at least four scholarly sources.

Must have enough slides for 10 minute presentation

Imagine that you have been chosen to represent a public health advocacy group as they begin a campaign to get legislation related to a health issue passed in your state legislature. You have been tasked with the role of presenting a proposed policy to the legislature and advocating that the legislature vote for the policy. You have been told that you will have 10 minutes to present to the legislature. Your presentation should be informative, but also persuasive. The legislature will need to make a decision about whether or not to vote for the policy based on your presentation. Your presentation should be structured exactly as if you were “live” in front of the legislature advocating for them to adopt the policy you are proposing.

For your assignment, you will need to select a public health topic on cardiovascular disease in the United States and a public health policy related to addressing the topic. You may select an actual proposed policy or create one that you think would effectively address the topic. Your presentation should provide enough information about the topic and the proposed policy that a reasonably educated legislator should be able to make an informed decision. Be sure to consider the various questions that a legislator might have about the issue and proposed policy, such as long-term costs and benefits, potential effects on business and industry (especially those that support politicians’ campaigns), and how the policy will support the health and productivity of state residents.

For this assignment, you should create an approximately 10 minute presentation* that addresses each of the following points:

Discuss the public health issue that your proposed policy is intended to address. Questions to consider:

Who does this health issue affect?

What is the impact of this health issue on the community?

Why does this health issue need to be addressed?

Explain the proposed public health policy. Questions to consider:

Who will be affected by this policy?

How will this policy address the health issue?

What will change by enacting this policy?

Evaluate the impacts of the proposed policy. Questions to consider:

What are the costs and benefits of the policy?

What are the risks of enacting or not enacting the policy?

How will the lives of people who are affected by the health issue change if this policy is enacted?

Create an influential presentation that affects voting behaviors of legislators. Questions to consider:

What information about this policy would potentially affect the voting behavior of legislators from across the political spectrum (eg. conservative, moderate, liberal, progressive; particularly those who might not support the policy based on political orientation)?

What are the most important messages that legislators need to hear about this policy?

How would the constituents of the legislators voting for this policy feel about this policy and a legislator who votes for it?

What information would a legislator need to “sell” the policy to constituents who were perhaps not in favor of adopting the policy?

    1. Depreciation expenses per year

Asset = Cash cost of new equipment – terminal salvage value

    Y 400,000 – Y 50,000 = Y350,000

Depreciation expense per year = asset/terminal salvage value

    Y 350,000/10yrs = Y35,000

Pretax cash inflow = revenues – incremental expenses

    Y 330,000 – Y 165,000 = Y135,000

    After-tax cash inflow = pretax cash inflow X (1 – tax rate)

    Y 35,000 X .6 = Y 21,000
