Purpose

Screening, Brief Intervention, and Referral to Treatment (SBIRT) is an evidence-based practice intervention used to identify, reduce, and prevent problematic use, abuse, and dependence on substances such as tobacco, alcohol, and illicit drugs. The SBIRT model was incited by an Institute of Medicine (IOM) recommendation that called for community-based screening for health-risk behaviors. The purpose of this assignment is to integrate SBIRT into nursing practice to help stimulate positive change at the individual and population-focused level of care.

Course Outcomes

This assignment enables the student to meet the following Course Outcomes (COs).

  • CO3: Plan prevention and population-focused interventions for vulnerable populations using professional clinical judgment and evidence-based practice. (PO4, PO8)
  • CO4: Evaluate the delivery of care for individuals, families, aggregates, and communities based on theories and principles of nursing and related disciplines. (PO1)

Due Date

Submit your completed SBIRT presentation by 11:59 p.m. MT Sunday of Week 6.

Final Contract Analysis, law homework help

Final Contract Analysis

Note: This is a two-part assignment that consists of two different contract analysis scenarios. Please answer both scenarios on one document, and upload it to Blackboard.

Contract analysis scenario one—damages determination: Alfred and Barbara own adjoining farms in Dry County, an area where all agriculture requires irrigation. Alfred bought a well-drilling rig and drilled a 400-foot well from which he drew drinking water. Barbara needed no additional irrigation water, but in January 1985, she asked Alfred on what terms he would drill a well near her house to supply better-tasting drinking water than the county water she has been using for years. Alfred said that because he had never before drilled a well for hire, he would charge Barbara only $10 per foot, about one dollar more than his expected cost. Alfred said that he would drill to a maximum depth of 600 feet, which is the deepest his rig could reach. Barbara said, “OKas long as you can guarantee completion by June 1, we have a deal.” Alfred agreed, and he asked for $3,500 in advance, with any further payment or refund to be made on completion. Barbara said, “OK,” and she paid Alfred $3,500.

Alfred started to drill on May 1. He had reached a depth of 200 feet on May 10 when his drill struck rock and broke, plugging the hole. The accident was unavoidable. It had cost Alfred $12 per foot to drill this 200 feet. Alfred said he would not charge Barbara for drilling the useless hole in the ground, but he would have to start a new well close by and could not promise its completion before July 1.

Barbara, annoyed by Alfred’s failure, refused to let him start another well. On June 1, she contracted with Carl to drill a well. Carl agreed to drill to a maximum depth of 350 feet for $4,500, which Barbara also paid in advance, but Carl could not start drilling until October 1. He completed drilling and struck water at 300 feet on October 30.

BBA 3210, Business Law 4

In July, Barbara sued Alfred, seeking to recover her $3,500 paid to Alfred, plus the $4,500 paid to Carl.

On August 1, Dry County’s dam failed, thus reducing the amount of water available for irrigation. Barbara lost her apple crop worth $15,000. The loss could have been avoided by pumping from Barbara’s well if it had been operational by August 1. Barbara amended her complaint to add the $15,000 loss.

In a minimum of a 1,000-word contract analysis, discuss Barbara’s suit against Alfred. What are Barbara’s rights, and what damages, if any, will she recover?

Contract analysis scenario two—remedies determination: Mundo manufactures printing presses. Extra, a publisher of a local newspaper, had decided to purchase new presses. Rep, a representative of Mundo, met with Boss, the president of Extra, to describe the advantages of Mundo’s new press. Rep also drew rough plans of the alterations that would be required in Extra’s pressroom to accommodate the new presses, including additional floor space and new electrical installations, and Rep left the plans with Boss.

On December 1, Boss received a letter signed by Seller, a member of Mundo’s sales staff, offering to sell the required number of presses at a cost of $2.4 million. The offer contained provisions relating to the delivery schedule, warranties, and payment terms but did not specify a particular mode of acceptance of the offer. Boss immediately decided to accept the offer and telephoned Seller’s office. Seller was out of town, and Boss left the following message: “Looks good. I’m sold. Call me when you get back so we can discuss details.”

Using the rough plans drawn by Rep, Boss also directed that work begin on the necessary pressroom renovations. By December 4, a wall had been demolished in the pressroom, and a contract had been signed for the new electrical installations.

On December 5, the President of the United States announced a ban on foreign imports of computerized heavy equipment. The ban removedfrom the American marketa foreign manufacturer that had been the only competitor of Mundo. That afternoon, Boss received an email from Mundo stating, “All outstanding offers are withdrawn.” In a subsequent telephone conversation, Seller told Boss that Mundo would not deliver the presses for less than $2.9 million.

In a minimum of a 1,000-word contract analysis, discuss the following questions: Was Mundo obligated to sell the presses to Extra for $2.4 million? Assume Mundo was so obligated. What are Extra’s rights and remedies against Mundo?

Civil Litigation Assignment, law homework help

Rarely will you be asked as a paralegal to research a template or sample complaint, as most law firms have standardized their own templates. However, it is useful to see several variations of complaints, especially in your own state. The basic requirements for all complaints are the same: the factual basis for the cause of action, the harm suffered, and the remedy sought. There are differences among various states as to the specificity of facts that must be alleged. For this week’s assignment, you are researching sample complaints, as well as information pertaining to complaints for your state.

First, research a Wisconsin court complaint and a federal court complaint for a federal court in Wisconsin. Explain the information from the two complaints by comparing and contrasting the similarities and differences between the two. Then, explain any pleading requirements for your state and how they differ from federal pleading requirements.

  • What remedies are potentially available to a plaintiff in a civil cause of action?

“As with the Rules, there are not many significant differences between federal and state complaints except in format. That is, all must include the duty breached, the harm done, and the damages claimed. The most important differences between complaints, whether state or federal, relate to the cause of action, i.e. criminal or civil or bankruptcy or divorce and so on. Fact/heightened pleading is just notice pleading with more facts, i.e.Spike, driving negligently,, caused an accident, i.e., running a red light, caused an accident. Once you are in your law firm, you will soon become acquainted with the complaints that are generally used by your lawyer.”

I AM NARROWING YOUR WRITTEN ASSIGNMENT AS NOTED BELOW: PLEASE FOLLOW THESE INSTRUCTIONS TO PRESERVE YOUR SANITY!!

  • What remedies are potentially available to a plaintiff in a civil cause of action? Please limit your response to EITHER the remedies for a tort or a breach of contract.

Manufacturing Budgets and posts, accounting homework help

Use the following Excel Template to complete your assignment for this week: Excel Template.

Given financial information, prepare Coopie Awards’ master

budget. Notice, you will prepare a different budget on each tab of the

spreadsheet. The last tab in the spreadsheet you will complete for the

discussion forum.

part 2 both posts need to be 100 words or more

The president of Coopie Awards was analyzing the actual and budgeted results of operations for the current year. She noticed several favorable variances and gave accolades to the production manager in a meeting. She also noticed that the sales variance was unfavorable and spent considerable time questioning the sales vice president. She stated: “If production hadn’t managed costs so well to cover for your lack of sales we would have racked up quite a large net loss for the year.”

For your initial post, discuss your reaction to the president’s comments, meeting demeanor, and professionalism. Would you have handled the situation the same if you were her? If not, what would you have done differently? Why?

After taking some time to reflect on the written assignment for the week regarding budget creation and variance analysis, address the following for your second post: Do you agree with the president’s comments regarding the management of production costs and the lack of sales? Please explain your position. Study the last tab of your budget assignment spreadsheet and complete a flexible budget on the tab. Where were costs actually in line and where were they out of line? What could have been done to produce more favorable numbers? Note that you will need to complete this tab before submitting your assignment to the drop box so your instructor can see your flexible budget.
