Assignment 1: Avoiding Unauthorized Practice of Law

Due Week 4 and worth 200 points

It is widely known that utilizing paralegals is a frequent concern for practicing attorneys, especially when a paralegal’s actions may leave them performing tasks (e.g., advising on legal rights, negotiation or settlement, management of a law practice, etc.) which could result in the unauthorized practice of law. Per the American Bar Association, one must possess a law license in order to perform such tasks.

Write a five to six (5-6) page paper in which you:

1. Determine three (3) most important characteristics of an effective paralegal. Justify your response.
2. Develop at least three (3) general guidelines for conducting legal research that a new paralegal should follow on in order to ensure that the attorney for whom the paralegal works is referencing valid laws within his / her legal documents.
3. Propose two (2) strategies that a paralegal could take in order to avoid the unauthorized practice of law. Provide a rationale to support your response.
4. Compare and contrast the key differences between the activities of paralegals versus those of attorneys in preparing a case for trial.
5. Use at least two (2) quality references. Note: Wikipedia and other Websites do not quality as academic resources.

Assignment 4: Merger, Acquisition, and International Strategies 
Due Week 8 and worth 300 points

Choose two (2) public corporations in an industry with which you are familiar – one (1) that has acquired another company and operates internationally and one (1) that does not have a history of mergers and acquisitions and operates solely within the U.S. Research each company on its own Website, the public filings on the Securities and Exchange Commission EDGAR database (http://www.sec.gov/edgar.shtml), in the University’s online databases, and any other sources you can find. The annual report will often provide insights that can help address some of these questions.

Write a six to eight (6-8) page paper in which you:

1. For the corporation that has acquired another company, merged with another company, or been acquired by another company, evaluate the strategy that led to the merger or acquisition to determine whether or not this merger or acquisition was a wise choice. Justify your opinion.
2. For the corporation that has not been involved in any mergers or acquisitions, identify one (1) company that would be a profitable candidate for the corporation to acquire or merge with and explain why this company would be a profitable target. 
3. For the corporation that operates internationally, briefly evaluate its international business-level strategy and international corporate-level strategy and make recommendations for improvement. 
4. For the corporation that does not operate internationally, propose one business-level strategy and one corporate-level strategy that you would suggest the corporation consider. Justify your proposals.
5. Use at least three (3) quality references. Note: Wikipedia and other Websites do not quality as academic resources.

• What role does ethics play in creating and guiding policy in the criminal justice system?
• What role does ethics play in the enforcement of laws?
• How does ethical enforcement relate to the role of investigating and combating terrorism?
• Is torture ethical in terrorism investigations? What if it saves hundreds of lives?
• How will ethics play into the future of law enforcement and related decision making?
• Should there be mandatory ethics courses? Why or why not? If so, how often should they be attended?
• Are there any police departments currently requiring mandatory ethics training on an annual basis? If so, what departments?
• What was one of the key points made during your collaborative group discussion this week?
